Before I start answering this question, I would like to draw your attention to the fact that before analysing what documents you need to gather it is very important to establish the following:

  1. Whether or not the spouse of a British citizen is in the UK or outside the UK. If they are outside – this will be an entry clearance application. This is a legal term for a visa application made outside the UK. If a spouse of a British citizen is in the UK – then it will most likely be further leave to remain application. This is a legal term for making an application in the UK.

From the question we know that the person is outside the UK.

  1. The second thing we need to establish is the source of British spouse’s income. There only 5 permitted sources of income which you can rely on when submitting your application.

From the question we know that a British citizen spouse is employed. This source of income is recognised by the Home Office.

  1. Thirdly, we need to know whether the person in question was the same employer for more than 6 months. If they were not, they will need to submit documents covering the last 12 months. However if they were with the same employer for more than 6 months, they will only need to submit documents covering the last 6 months only.

a) Payslips covering:
(i) a period of 6 months prior to the date of application if the person has been employed by their current employer for at least 6 months; or
(ii) any period of salaried employment in the period of 12 months prior to the date of application if the person has been employed by their current employer for less than 6 months, or in the financial year(s) relied upon by a self-employed person.

(b) A letter from the employer(s) who issued the payslips confirming:
(i) the person’s employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

Key Document No3

(c) Personal bank statements corresponding to the same period(s) as the payslips at paragraph 2(a), showing that the salary has been paid into an account in the name of the person or in the name of the person and their partner jointly.

Please remember that all the documents you are submitting must be original documents and English language.
